Terms of Service

1. Eligibility

You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that you meet this age requirement and have the authority to enter into these Terms. If you are using the Services on behalf of another person, couple, or organization, you represent that you have the authority to bind them to these Terms.

2. Account Registration and Security

• Provide accurate and current information when creating or updating your account.
• Keep your login credentials and devices secure. You are responsible for all activities that occur under your account, including contributions by your invited partner.
• Notify us immediately at [email protected] if you believe your account has been compromised.

3. Content Ownership and Licenses

• You retain ownership of the photos, notes, stories, locations, and other content you submit to the Services ("User Content").
• By uploading User Content, you grant Mo Systems a worldwide, non-exclusive, royalty-free license to host, store, display, process, and distribute that content solely to operate, improve, and provide the Services, including enabling collaboration with your invited partner.
• You represent that you have the necessary rights to upload and share User Content and that it does not infringe, misappropriate, or violate the rights of any third party.

4. Acceptable Use

While using the Services, you agree not to:

• Upload, share, or store content that is unlawful, harmful, defamatory, or obscene.
• Harass, threaten, or impersonate others, or collect personal information without consent.
• Interfere with or disrupt the Services, servers, APIs, or networks connected to the Services.
• Reverse engineer, decompile, or attempt to access the Services' source code or data.
• Use automated scripts, bots, or scrapers to access the Services without prior permission.
• Use the Services for commercial solicitation or to promote competing products without our written consent.

We may investigate and take appropriate action, including terminating accounts or removing content, if we believe you are violating these Terms or applicable law.

5. Service Features and Third-Party Tools

• The Services rely on third-party providers, including Supabase for cloud database and file storage, PostHog for analytics and product insights, and Amazon end user messaging services for SMS verification codes. Your use of the Services authorizes us to share necessary information with these providers as described in our Privacy Policy.
• We may add, modify, or remove features at any time. We will make reasonable efforts to notify you of changes that materially impact your use of the Services.
• Trial, beta, or experimental features may be offered on a pre-release basis and are provided "as is" without warranties of any kind.

6. Communications

By providing your phone number or email, you consent to receive transactional messages related to account access and verification. At this time we only send SMS one-time passcodes through Amazon end user messaging services to authenticate your login attempts. You can stop receiving these messages by replying "STOP" or contacting us; doing so will block future verification codes and may prevent access to your account until you opt back in.

7. Data Practices

Our data collection, use, and retention practices are explained in our Privacy Policy. By using the Services, you acknowledge that your personal information will be processed in the United States and other locations where our service providers operate. We retain your data for as long as your account is active, and we will delete or anonymize it upon verified request, subject to legal obligations.

8. Termination

• You may discontinue use of the Services at any time and request account deletion.
• We may suspend or terminate your access if we believe you violated these Terms, created risk or legal exposure for others, or for any other reason with advance notice when feasible.
• Upon termination, certain provisions of these Terms will survive, including those relating to ownership, disclaimers, limitations of liability, and dispute resolution.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MO SYSTEMS AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Mo Systems and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts. To the extent permitted by law, you and Mo Systems agree to resolve disputes on an individual basis and waive any right to participate in a class or representative action.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by contacting you directly. The updated Terms will be effective on the date posted. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
